Welcome to Ikaroa Falls. These Terms and Conditions ("Terms") govern your use of our website, the purchase of retail products (online and in-house), and the procurement of professional services, including but not limited to cremation, ceremonies, and commemorative events. By engaging our services or purchasing our products, you agree to be bound by these Terms.

1. Services and Professional Care

Ikaroa Falls provides professional death care services, including memorial ceremonies and cremation.

  • Authorization: All services must be authorized by the legally recognized Next of Kin or an appointed Personal Representative.

  • Compliance: Our services are conducted in strict accordance with state and federal regulations, including the FTC Funeral Rule. Itemized pricing is available via our General Price List (GPL).

2. Retail and Merchandise

We offer a curated selection of funeral merchandise, including urns, keepsakes, and commemorative items.

  • Availability: We strive for accuracy in our online inventory; however, certain items (specifically dropship urns) are subject to third-party availability.

  • Product Representation: We make every effort to display font styles, artwork, and product colors accurately. However, due to the natural materials of many urns (wood, stone, etc.) and monitor variations, slight aesthetic differences are to be expected and do not constitute a defect.

3. Personalized and Engraved Items (No-Return Policy)

At Ikaroa Falls, we take pride in the custom nature of our commemorative products.

  • Final Sale: Any item that has been personalized, engraved, or otherwise customized is considered a Final Sale. These items are uniquely tailored to your specifications and cannot be resold or returned.

  • Customer Responsibility: It is the customer's responsibility to review all spelling, dates, font choices, and artwork selections before submitting an order. Once a personalized order is placed, production may begin immediately.

  • Errors/Mistakes: Returns or replacements will only be accepted if the error was made by Ikaroa Falls or our manufacturing partners (e.g., the engraving does not match the text provided in your order form). In such cases, please notify us within 48 hours of receipt to initiate a correction.

4. General Returns (Non-Personalized)

  • For non-personalized retail items, returns may be accepted within 14 days of purchase, provided the item is in its original, unused condition and packaging.

  • Shipping costs for returned items are the responsibility of the customer.

5. Ceremonies and Event Logistics

  • Cancellations: Fees for scheduled ceremonies, facility rentals, or professional staff time may be subject to a cancellation fee if not cancelled within the timeframe specified in your Service Agreement.

  • Liability: While we exercise the utmost care during ceremonies and the handling of remains, Ikaroa Falls is not liable for the behavior of guests or for items left unattended during public or private services.

6. Limitation of Liability

To the fullest extent permitted by law, Ikaroa Falls and its employees shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or the performance of our services. Our total liability shall not exceed the amount paid for the specific product or service in question.

7. Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms shall be resolved in the courts of San Diego County.
